We have prepared this Privacy Notice to explain how, why, and when we collect data from you on our website and services. We comply with U.S. and global privacy laws, including the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and the Children’s Online Privacy Protection Act (COPPA).

Please note that this Privacy Notice only applies to data that we collect when you visit the Tuxler website at https://tuxlervpn.com or use our services.

About Tuxler’s Services

Tuxler provides targeted advertising services for our advertiser clients (“Advertisers”). When you visit a website operated by an Advertiser or a third-party site where we could serve an ad to you, we may collect some or all of the data described in this Privacy Notice. Our platform uses that data as well as other data described below to help Advertisers provide ads that are more relevant to you.

For example, if you visit an Advertiser’s website and shop for running shoes, our Platform may later serve you with targeted ads for the Advertiser’s brand of running shoes as you browse the internet.

What Data We Collect and How We Use It

 We collect data under the following legal bases:

Consent – When you opt-in to marketing communications or cookies.
Legitimate Interest – To improve our services, prevent fraud, and ensure security.
Contractual Necessity – To provide TuxlerVPN services and process transactions.
Legal Obligations – To comply with regulatory and law enforcement requirements.

We may collect the following categories of information on our website and use them for the purposes explained below:

Website activity: Data about your browsing activity on our website.
Device and browser information: Technical information about the device or browser you use to access our website. For example, your device’s IP address and (in the case of mobile devices) your device type and mobile device’s unique identifier such as the Apple IDFA or Android Advertising ID.

Account Information: If you open an account, we will collect your username, password, and other necessary information to access your account.

When you use the free version of TuxlerVPN’s services, your device’s internet connection and IP address may be used to route network traffic for other participants in the TuxlerVPN network. This means that while TuxlerVPN is installed under the free service, data from other users may pass through your network connection, whether or not you are connected to a VPN location.

Access to the TuxlerVPN network is provided by Tuxler and may also be made available to, licensed to, or resold to third parties, including business and commercial customers, who may route their traffic through your connection and IP address in the same way.

This applies only to the free version. If you prefer not to participate in network sharing, you can opt out by purchasing a Premium subscription, whose devices are never used to route traffic for others, or by uninstalling the app.

We may disclose personally identifying information (PII) about you:

With our service providers: Companies we contract with that help with parts of our business operations. We require that our service providers only use your PII in connection with the services they perform for us.
With your service providers: Companies under contract with or acting on your behalf who handle data (such as customer lists) on your behalf.
With our subsidiaries and related companies.
In connection with legal proceedings: When we are under a legal obligation to do so, for example, to comply with a binding order of a court, or where disclosure is necessary to exercise, establish, or defend the legal rights of Tuxler, our Advertisers, or any other third party.
In connection with a sale of our business: If a third party acquires some or all of our business or assets, we may disclose your PII in connection with the sale.
We also share technical data that we collect about your browsing habits and your device (such as data relating to our cookies, tracking pixels, and similar technologies) with other advertising companies in the digital advertising ecosystem.
California Residents: You can use Cookie settings / Do Not Sell or Share, when shown, or the Cookie settings link in the footer to turn off optional website tracking. We also respect supported Global Privacy Control signals as described below.

The Tuxler website uses cookies, tracking pixels, and related technologies. Cookies are small data files that are served by our platform and stored on your device. Our site uses cookies dropped by us or third parties for a variety of purposes, including operating and personalizing the website. Cookies may also track how you use the site to target ads to you on other websites.

For more information about cookies and similar technologies used on this website, see our Cookie Policy. You can review or change Analytics, Advertising and Affiliate referral attribution separately through Cookie settings in the website footer or the persistent settings button.

Optional tracking stays off while the website checks its configured regional policy. Depending on that result, it either requires prior consent or presents a notice with an option to reject. A saved refusal and a supported Global Privacy Control signal override automatic defaults. An unavailable policy result or a blocked location keeps optional tracking off. Global Privacy Control disables all three optional categories in this implementation.

Where Affiliate referral attribution is allowed, we may retain a referral identifier supplied as cid or app_unique_id and pass it to the applicable payment flow to attribute a purchase to a partner. We check current preferences before writing or using this identifier. You can still purchase when optional attribution is rejected. Direct checkout entrypoints may show a privacy step so a referral is not used without the required current preference.

Explicit website privacy choices are remembered for up to 180 days; an automatic regional result is stored for up to one hour and refreshed during use. Withdrawing a category stops the related tracking and removes accessible first-party cookies. This does not automatically erase data already received by a provider; you may contact us to exercise applicable rights.

Website Form Security — Google reCAPTCHA

We use Google reCAPTCHA to help protect website forms against automated submissions, spam, and abuse. When a page containing a protected form loads, your browser connects to Google and sends technical information for security analysis, including your IP address and browser request information. Google may also use the _GRECAPTCHA cookie to perform its risk analysis.

Tuxler Privacy Technologies, Inc. acts as controller of reCAPTCHA Customer Data. Google processes that Customer Data on our behalf under the applicable Google Cloud Terms of Service, Service Specific Terms, and Cloud Data Processing Addendum. Google’s Service Specific Terms limit its use of information submitted through this service to providing and maintaining the service and its security capabilities, and exclude use for personalized advertising by Google.

These form-security checks operate independently of the Analytics and Advertising / Marketing choices in our cookie settings. Rejecting those categories does not disable reCAPTCHA. We use reCAPTCHA for form security rather than to measure advertising campaigns. Further information about its cookies and activation is in our Cookie Policy.

Data Retention & Deletion

PII is held no longer than necessary for our business purposes or to meet legal requirements.
Billing & transaction records: Retained for 7–10 years (per U.S. tax laws).
Customer support data: Retained for 2 years after resolution.
Account information: Retained until account deletion request.
Marketing data: Retained until opt-out request.

Data Security & Breach Notification Policy

Tuxler will notify affected users within 72 hours in case of a data breach.
If over 500 California residents are affected, we will notify the CA Attorney General.

Children’s Data (COPPA Compliance)

Tuxler does not knowingly collect data from individuals under 18.
If we learn that a minor has provided personal data, we will delete it promptly.
